Article 1: General provisions

Hereinafter referred to as "Etta".

These terms and conditions (the "Terms") govern the use of the Website and the products or services offered on it. By using the Website, the "Customer" agrees to these Terms in their entirety.

Article 2: Use of the Website

The Customer must be at least 16 years old to use the Website and agrees to provide accurate and up-to-date information when using the Website and during the checkout process.

Article 3: Products and Services

Etta offers products and/or services for sale on the Website. All products and services are subject to availability. All prices stated on the Website are expressed in EURO, always including VAT and all other duties or taxes required to be paid by the Customer.

The price statement applies exclusively to the items as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Despite the fact that the online catalogue and the Website have been compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer do not bind Etta. Etta is only obliged to make an obligation of means with regard to the accuracy and completeness of the information provided. Etta is under no circumstances liable in the event of manifest material errors, typesetting or printing errors. Prices for products and services listed on the Website and are subject to change without prior notice.

All offers are valid while stocks last. Stocks can be adjusted or withdrawn at any time by Etta. Etta cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer. Etta has the right to sell all items listed under the business unit details.

Article 4: Online purchases

4.1. Products and services information

Customers have the option to obtain products/services information via:

  • The website. Detailed information is shown for each products/service, ingredients, schedule and all remarks.
  • By email. The Customer can always send an email for further information on products/service. Every effort will be made to respond to the Customer's inquiries within 1 working day.

4.2. Order process

The order is created by reserving the selected products in the shopping cart. The Customer then has the choice to continue shopping or pay. By pushing the 'Continue payment' button the purchase starts being processed until the time the Customer completed an order:

  • Personal details: if desired, the Customer can provide his details by creating an account or paying as a guest. The 'Continue' button takes the Customer to a window where the Customer must provide his shipping address.
  • The 'Continue' button takes Customer to a window where the Customer should select the shipping method; either home delivery or self-collection.
  • The next 'Continue' button will take Customer to a window where the Customer could complete the payment.
  • The Customer chooses the payment method and must agree to the Terms and the right of withdrawal. By clicking on 'Order and pay' the order is then completed.
  • After payment, the Customer will receive an email confirming the order and the receipt of payment. A tracking email is automatically sent via the shipping company so that the Customer can track his order.

4.3. Status of the order

Updates email on the status of order will be sent to Customer and the movement of shipment can be traced through the shipping company.

Regardless of the payment method, you always have the option to request an invoice. We prefer that sales for professional customers are not made through the Website and strongly recommends for professional buyers to contact us through email.

Etta is entitled to refuse an order (in writing) due to a serious shortcoming on the part of the Customer with regard to the order or any other order or agreement in which the Customer is involved.

Article 5: Delivery and execution of the agreement

Items ordered from the Website are delivered within the European Union to the Customer's home address or to a collection point of chosen by Customer.

Delivery modalities: Products will be shipped after the receipt of Customer's payment. Shipments are made twice a week; on Mondays and Wednesdays. Etta can expand this further.

Delivery is made via the shipping company; Bpost, Post NL, GLS, Mondial Relay and DHL. Standard delivery at home or collection point in Belgium usually takes 3-4 working days and other EU countries between 5 - 7 days.

Etta cannot be held responsible for any force majeure, strikes or delays by the shipping company. Etta will always try to inform Customers about delays through the shipping company.

Any visible damage and/or qualitative shortcoming of an item or other shortcoming during delivery must be reported by the Customer to Etta without delay.

The risk of loss or damage passes to the Customer once he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Etta.

5.1. Inquiry in case of non-delivery

If an order has not been delivered, we will follow up with the shipping company (Bpost, Post NL, GLS, Mondial Relay, DHL). The Customer will normally receive the order again, the costs of the lost products will be recovered from the shipping company.

5.2. Incorrect delivery

If the wrong number or too few products are delivered, they will still be delivered in a new order. Depending on the cost of shipping and the price of the products, the Customer can keep them or return them.

5.3. Damaged products

If a product is damaged, it will be delivered free of charge to the Customer in a subsequent order. The costs will then be recovered from the shipping company if it appears that the packaging itself was done correctly.

5.4. Late delivery

This option is included in the general terms and conditions. The shipping company cannot guarantee 100% that delivery can always be made the next working day. The Customer can also follow the movement of delivery through the tracking facility provided by the shipping company.

Article 6: Retention of title

The delivered items remain the exclusive property of Etta until full payment has been made by the Customer.

If necessary, the Customer undertakes to inform third parties of Etta's retention of title, for example to anyone who would seize items that have not yet been fully paid for.

Article 7: Returns and refunds or cancellation of service policy

Please review this policy before making a purchase.

7.1. Products

The Customer has the right to return the products within a period of 14 calendar days without giving reasons. This is only valid on dry food/goods that are unopened and undamaged. To exercise the right of withdrawal, the Customer must inform Etta (email: info@bumietta.be) of his decision to withdraw from the agreement by means of an unequivocal statement. After the cancellation, the Customer will receive an email explaining in detail the instructions on how to return the products. Etta will make every effort to offer other products as replacement or make arrangements regarding the refund, but the fee of shipment when returning the products is always at the Customer's expense.

To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return the goods without delay, but in any case, no later than 14 calendar days after the day on which he communicates his decision to withdraw from the agreement to Etta, or hand them over to the shipping company that Etta will notify at that time. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

If the returned product has been reduced in value in any way, Etta reserves the right to hold the Customer liable and claim compensation for any reduction in value of the goods resulting from the use of the goods by the Customer; goes beyond what is necessary to determine the nature, characteristics and functioning of the goods.

If the Customer revokes the agreement, Etta will refund all payments received from the Customer up to that time, excluding standard delivery costs, to the Customer within a maximum of 14 calendar days after Etta has been informed of the Customer's decision to terminate the agreement. For sales contracts, Etta may withhold reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.

Additional costs resulting from the Customer's choice for a return will not be refunded by Etta.

Etta will reimburse the Customer using the same payment method with which the Customer performed the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such reimbursement. Etta will pay the customer the full amount of the returned goods that meet the type of dry food with a best before date, with the exception of the shipping costs incurred by returning the goods.

The Customer cannot exercise the right of withdrawal for:

  • the delivery of goods manufactured according to the Customer's specifications, or that are clearly intended for a specific person;
  • the delivery of goods that spoil quickly or have a limited shelf life;
  • the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery;
  • the delivery of goods that, by their nature, are irrevocably mixed with other products after delivery;

7.2. Service

Cancellations or reschedule of reservation made up to 48 hours before a scheduled date of service via [email, text, phone call] will be processed without a penalty.

Cancellations or reschedule of reservation made 48 hours or less before the date of service will be subject to a charge of 50% of the total service rate. This includes the reasons where our service provider is unable to access the property, is turned away, or the client is a no-show.

Article 8: Intellectual Property

All content on the Website; including text, images, logos, and trademarks, is the property of Etta and is protected by intellectual property laws.

Article 9: Limitation of Liability

Etta is not liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the Website or the purchase of products or services.

Article 10: Force majeure

Force majeure is any circumstance beyond our will and control that prevents the fulfilment of our obligations in whole or in part. This includes, among other things: strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of our website at any time, non-delivery or late delivery from suppliers or other engaged third parties.

In the event of force majeure, we are not obliged to fulfil our obligations. In that case, we can either suspend our obligations for the duration of the force majeure or definitively terminate the agreement.

Article 11: Sanctions for non-payment

Without prejudice to the exercise of other rights available to Etta, in the event of non-payment or late payment, the Customer is legally liable to pay interest of 10% per year on the unpaid amount from the date of the default and without notice. In addition, the Customer is legally liable and without notice to pay a lump sum compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Etta reserves the right to take back items that have not been (fully) paid for.

Article 12: Affecting validity - non-renunciation

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. The failure at any time by Etta to enforce any of the rights listed in these Terms, or to exercise any right thereof, will never be considered a waiver of such provision and will never affect the validity of these rights.

Article 13: Changes to Terms

The Terms may be changed at any time without prior notice. Customer is responsible for reviewing these Terms periodically. When placing the order, the General Terms and Conditions will apply as they were at the time the sale was concluded. Any order placed after changing or supplementing the Terms constitutes acceptance of the new Terms.

Article 14: Evidence

The Customer accepts that electronic communications and backups can serve as evidence.

Article 16: Applicable law - Competent court

Belgian law applies. The courts of the Etta's location have jurisdiction in legal disputes.
